Acceptance of Terms of Service Agreement (TOSA) The use of the Mag-Tag.com tracking software and the purchase of any Mag-Tag product, is indicative of your acceptance of the terms outlined in this TOSA. General terms Mag-Tag does not charge a fee unless indicated upon the acceptance of a purchasing agreement between the customer (you) and Mag-Tag.com. There is no "per message" fee charged by Mag-Tag.com for each event in which a Mag-Tag lost and found tag is found. However, your Cellular carrier may charge a fee to receive a text (SMS) message. Please consult your cellular carrier for details on your sMS fees. Mag-Tag.com does not guarantee the successful transmission of e-mail or SMS messages due to metwork operating conditions of cellular equipment as well as the possibility of inaccurate data entered at the time of activation. Mag-Tag.com is not responsible for inacurate data entered by its customers. Mag-Tag.com does not make any guarantee, neither implied or direct, that your lost items will be returned by the person who finds them. Mag-Tag.com makes no guarantee that your list items will be found. Mag-Tag.com does not imply or directly state that it is an insurance policy of any kind, and cannot be held liable for items that are lost but not found or returned by the finder. mag-Tag.com is not responsible for the safe return of lost items, and will not intervene when a dispute arises between the owner of an item and the person who finds the lost item. Mag-Tag.com does not have any role in the process of finding list items, but is mearely a system through which initial communication can be established between the owner of a lost item and the finder of the lost item. Mag-Tag will not be held responsible for loss of business, damage to personal property, and/or lost opportunities due to interruption of our service. Accessing the Mag-Tag Database in any way other than is intended through our web interface is strictly prohibited. Any user caught in engaging in any activity that could negatively affect our service or our ability to serve our clients will be prohibited from use of our system, and subsequently blocked based on IP and/or other credentials. Privacy policy Mag-Tag only collects the personal information necessary for the immediate contact of the individuals involved in the ownership and finding process of the items to which a mag-tag lost and found tag is attached. Mag-Tag.com does not use personal information for any other reason than stated on the Mag-Tag.com website. Mag-Tag.com does not disclose personal information to the finder of the item. Personal contact information of the person who finds a Mag-Tag lost and found tag is immediately forwarded to the owner of the Mag-Tag device so the owner has a measn through which they can contact the finder. Mag-Tag is not responsible for the accuracy of the information provided by the finder. Personal information will not be divulged by Mag-Tag unless required by a court order. Indemnification You agree to indemnify and hold Mag-Tag.com, and its affiliates, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to your use of the Service, your violation of the Terms of Service, and/or your violation of any other right of any person or entity. Service Interruptions You agree not to hold Mag-Tag.com liable for any cost incurred due to service interruptions of any kind. Service interruptions include but are not limited to network outages, cellular signal deficiencies, and power related outages. If, at any point in time Mag-Tag.com decides to go out of existence, you agree not to hold any party affiliated with Mag-Tag.com responsible for any losses of any kind. Disclaimer USE OF THIS SERVICE IS PROVIDED "AS IS, WHERE IS," AS AN ACCOMMODATION, AND WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL Mag-Tag BE LIABLE FOR DAMAGES OF ANY KIND TO YOU FOR ANY DEFICIENCY, ERROR, OR INTERRUPTION IN THE SERVICE PROVIDED HEREUNDER. YOUR SOLE REMEDY IN THE EVENT OF ANY DEFICIENCY OR ERROR SHALL BE TO REQUEST THAT Mag-Tag CORRECT THE MATTER OR INFORMATION PROVIDED OR, IF Mag-Tag FAILS TO DO SO, TO DISCONTINUE USE OF THE SERVICE AT YOUR OPTION. Changes to Terms of Service This TOSA may change at any time. Use of the Mag-Tag service is considered acceptance of the new TOSA. If you disagree with any of the clauses in the TOSA, you will discontinue use of our service immediately.
